Pink Floyd, one of America’s most successful rock band managed to win the court fight against EMI, in a case which involves the selling of Pink Floyd’s individual songs as online downloads. The High Court ruled that without Pink Floyd’s consent, EMI music wasn’t entitled to earn any profits via the Web or any other medium.
Pink Floyd had argued in the lawsuit that EMI was violating the selling rights by putting individual songs on sale. EMI had counter argued by saying that the clause was valid for only the DVDs or albums. The issue has primarily arisen because Pink Floyd’s most recent album was signed pre-digital music era. The story which appeared in BBC did not make it clear whether Pink Floyd didn’t want the sale of their individual songs to occur on the web at all or just that EMI wasn’t allowed to go ahead with the same. EMI was fined $60,000 and an additional fee which was to be decided later. Pink Floyd also suffered due to the inconsistent payment of royalties on downloads.
